Last Minute Attempt by Ströer/DSM to Subvert Münster Tendering Procedure

One day before the expected decision of Münster's city-council concerning municipal marketing rights, Udo Müller, Chief Executive of Ströer AG, has repeatedly attacked Wall AG in front of media representatives. Müller claimed that Berlin outdoor advertiser and street furniture supplier Wall AG failed to create an exclusive design line for the city of Münster. In spite of the tendering procedure not yet being closed officially, Wall AG feels forced to publicly reject accusations.

Wall AG did entrust renowned architects Kleihues + Kleihues with the creation of an exclusive design line for Münster's street furniture and advertising displays. As architects of Münster-Arcades, Kleihues + Kleihues, who also have offices in the city, were predestined to take over this task. On the basis of a thoroughgoing architectural analysis of the cityscape, a design was developed which uniquely mirrors typical colours and architectural elements of the city. The design was patent registered by Wall AG.

"A fair and public tendering procedure in a German city is massively disrupted by one of the competitors." Daniel Wall, Chief Executive Officer of Wall AG, points out. "A company which holds an almost dominant position on the German market by all means tries to subvert free competition, and with a slanderous attack unfairly seeks to bring into disrepute a competitor. Thus Ströer AG has disqualified itself as a potential partner for cities. We are going to take immediate legal action against these unfounded allegations and will eventually claim damages."

For 80 years DSM has held a monopoly in the city of Münster which, according to media reports, is on the verge of being broken. In 2004 DSM was acquired by Cologne based Ströer AG. Ströer/DSM has already unsuccessfully filed suits against acceptance of Wall AG's tenders in Reutlingen and Freiburg. According to courts, Ströer/DSM could not appeal to the exertion of its right to lease, because it was not able to provide the design line requested by the city. "In order to avoid any detriment to the city of Münster, we have, in the course of the tendering procedure, guaranteed that it will be exempt from all legal and financial risks", Daniel Wall confirms.
